Increased Definition of Discrimination

The definition of harassment in regards to tenants has now expanded to include citizenship status.

The list of items that a person cannot be discriminated against is based on actual or perceived:

  • Age
  • Race
  • Creed
  • Color
  • National Origin
  • Gender
  • Disability
  • Marital Status
  • Partnership Status
  • Caregiver Status
  • Uniformed Status
  • Sexual Orientation
  • Alienage or Citizenship Status
  • Lawful source of income
  • Status as a victim of domestic violence, sex offenses, or stalking
  • Children are/would be residing in unit

Nobody’s residency in a unit can be threatened based off of any of these characteristics.

As a landlord, you cannot ask for any kind of documents that would prove or disprove them being or not being a citizen. The exemption of this is if there’s a legal requirement for why these documents are necessary.

Tenant harassment is often used as a tactic to remove a batch of tenants from properties, in order to raise the rent for the following tenants. This creates an issue in regards to affordable housing.
